Scope and subject of the General Terms and Conditions
These General Terms and Conditions («GTC») govern the relationship between the customers (hereinafter «Customer») and Aronia Vital (hereinafter «Provider»)
By ordering an offer or using one or more of the provider’s services, the customer agrees to the application of the present General Terms and Conditions,
When ordering or using offers from third-party providers (e.g. Google), the third-party provider's terms and conditions apply.
Conclusion of contract
The provider's offers are subject to change. All information and prices remain non-binding until the final order is placed.
A contract is only concluded upon confirmation of the order.
Scope of services
The scope of services provided by the provider is determined by the contract concluded with the customer.
The provider cannot guarantee uninterrupted operation for its own services or those of third-party providers. However, the provider strives to resolve technical problems within its area of responsibility as quickly as possible, or to have them resolved. Technical interruptions, e.g., for maintenance work, will be kept as short as possible and, if possible, completed during off-peak hours.
The provider reserves the right not to accept, remove or permanently delete content for legal, moral or other reasons.
Data protection
The provider complies with the provisions of the Swiss Data Protection Act when collecting, processing and storing data.
The customer agrees that the provider may collect and process the customer's data for market research, consulting and advertising purposes.
Data will only be shared with third parties to the extent necessary to provide the contractual services. The provider assumes no liability for the collection, processing, or storage of data by third parties.
Payment terms
The remuneration agreed in the contract is due within 30 days of receipt of the invoice.
All prices are in Swiss francs and exclude VAT.
If the payment deadlines are not met, the customer will automatically be in default.
Liability
The provider is only liable for direct damages if the customer proves that these were caused by gross negligence or intent on the part of the provider or its vicarious agents. The amount of compensation is limited to the agreed remuneration.
Any further liability of the provider and its vicarious agents for damages of any kind is excluded. In particular, no claim for compensation exists for consequential damages, consequential damages due to defects, lost profits, unrealized savings, loss of earnings, loss of production, revenue, or earnings, loss of use or data, or interruptions in the operation of the provider's services or those of third-party providers, or the internet.
The provider assumes no warranty or liability for offers from third parties.
Other provisions
Should any provision of these Terms and Conditions be or become invalid or ineffective, the validity and effectiveness of the remaining provisions shall remain unaffected. In such a case, the invalid provision shall be reinterpreted or amended to achieve the intended purpose as closely as possible.
Changes to these Terms and Conditions will be communicated to the customer in writing or by other suitable means (e.g. via email or internet) and will take effect without written objection from the customer within one month of notification.
Changes and additions to the contract between the provider and the customer must be made in writing.
Applicable law and jurisdiction
These Terms and Conditions and the contracts concluded between the Provider and the Customer are subject to Swiss law (excluding the United Nations Convention on Contracts for the International Sale of Goods, concluded in Vienna on April 11, 1980).
The place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is the respective registered office of the provider, currently Wattwil. The provider is entitled to sue the customer at the general place of jurisdiction of his or her place of residence or registered office.

Shipping times depend on product availability and the respective shipping company. We cannot be held liable for any delays.
Liability for all damages attributable to the shipping company is excluded.
If the delivery does not correspond to the order, the costs of return and reshipment will be borne by Aronia Vital.
The correctness of the order is the responsibility of the customer. Should the delivery correspond to the order, an exchange of goods will only be made at the customer's expense.
A return of goods will only be accepted if the product is unopened and the packaging is undamaged.
